Terms of Service

1. Introduction and Acceptance

Domi Medical Smpc (G.E.MI.: 144207803000, VAT No.: 800889867) provides the doctorcalls.gr service, a platform of artificial intelligence voice representatives (Voice AI Agents) that perform incoming and outgoing calls, provide SMS/Email message summaries, and are accompanied by an API and additional features. By creating an account and/or using the platform, the Customer/User declares that they have read, understood, and fully accept these Terms of Service.

2. Definitions

“Customer” or “User” means any natural or legal person who gains access to the service. The term “Agent” refers to the autonomous digital voice assistant created and managed through the platform. “AI Minutes” means the speech processing computational time consumed during the operation of the Agents. “Subscription” means the User’s active service plan. “Add-On” means any optional feature that may be added to the basic Subscription. “Customer Data” means the information that the User enters or generates through the use of the service.

3. Account Registration and Eligibility

To create an account, the User shall provide accurate identification information and declare that they are acting for business purposes and have reached the age of eighteen (18). Domi Medical Smpc reserves the right to reject or suspend accounts that do not meet legal requirements or exhibit unlawful conduct.

4. Subscription Plans

The service is offered through tiered plans (indicatively Starter, Skilled, Advanced, and Enterprise), which differ in terms of the features provided, concurrent call limits, and available functionalities. The pricing details and activation terms of each plan are determined in a separate commercial policy document, which does not form part of these Terms.

5. Trial Period and Beta Features

Domi Medical Smpc may provide trial access or features in a testing stage. These capabilities are provided “as is” and may be withdrawn or modified without prior notice.

6. Fair Use and Technical Limitations

The platform applies rate-limiting mechanisms, maximum concurrent call limits, and API usage limits in order to maintain the stability and security of the service. The Company reserves the right to temporarily or permanently suspend an account where abuse or unusual traffic is detected.

7. Payments, Billing and Taxes

The service is billed on a recurring basis, in accordance with the terms agreed upon when the Subscription is activated. The User is required to pay all invoices in a timely manner. In the event of late payment, the Company may suspend the service until all outstanding amounts have been fully settled. Detailed billing terms are governed by a separate commercial policy.

8. Cancellation, Upgrade and Downgrade

The User may terminate the Subscription at any time, effective at the end of the current billing period. Subscription upgrades take effect immediately, while downgrades take effect from the next billing cycle. Prepaid fees are non-refundable unless otherwise required by applicable law.

9. Partner Program

Domi Medical Smpc offers separate Partner Programs. Participation requires acceptance of the specific terms of each program, including compliance obligations under the applicable data protection legislation.

10. Data Protection

Domi Medical Smpc processes Customer Data for the provision and support of the service and implements technical and organizational security measures in accordance with the GDPR and Greek law. In the event of a data breach, the Company shall notify the competent supervisory authority and the Customer without undue delay.

With regard to the data submitted within the framework of the Voice AI Agents services, Domi Medical Smpc acts as the Data Processor and processes such data solely upon the documented instructions of the respective Data Controller. The specific terms are governed by the applicable Data Processing Agreement (DPA), which forms an integral part of these Terms and is available at https://www.doctorcalls.gr/el/dpa-el.

11. Confidentiality and Security

Non-public information shall be considered confidential and shall not be disclosed without prior approval, unless required by law or court order. The platform is hosted on infrastructure that complies with internationally recognized security standards.

12. Intellectual Property

All rights relating to the software, artificial intelligence models, and the platform content belong to Domi Medical Smpc. The User retains full rights to their own data.

13. Acceptable Use

The use of the platform for unlawful, harmful, or abusive activities, mass unsolicited calls, or emergency services is prohibited. The Company may suspend any account that violates this policy.

14. Disclaimer of Warranties

The service is provided “as is.” No warranty is given regarding uninterrupted operation or the absolute accuracy of the results.

15. Limitation of Liability

The total liability of Domi Medical Smpc for direct damages shall be limited to the total fees paid during the previous three-month period. Any liability for indirect or consequential damages is excluded.

16. Indemnification

The User shall indemnify the Company against third-party claims arising from the unlawful use of the service.

17. Suspension and Termination

Either party may terminate these Terms by providing thirty (30) days’ written notice. The Company reserves the right to suspend the service immediately in the event of a material breach.

18. Amendments

Domi Medical Smpc may revise these Terms upon providing relevant notice. Any changes shall become effective after thirty (30) days.

19. Governing Law

These Terms shall be governed by the laws of Greece. The Courts of Athens shall have jurisdiction.

20. Dispute Resolution

The parties shall seek an amicable resolution of any dispute. Failing such resolution, they may resort to mediation and subsequently to the competent courts.
